Terms of Service
Welcome to VirWave. These Terms of Service ("Terms") govern your use of the VirWave mobile application (the "App") operated by VirWave OAM ("we," "us," or "our").
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The Service
VirWave is a breathing and emotional regulation companion app. The App provides guided breathwork exercises, a personal journal, and optional social connections with other users. The App is not a medical device and does not provide medical advice, diagnosis, or treatment.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.
3. Accounts
- You may use certain features of the App as a guest without creating an account.
- To access cloud sync, journal, connections, and other personalized features, you must create an account using email/password, Google, or Apple sign-in.
- You are responsible for maintaining the confidentiality of your account credentials.
- You may delete your account at any time from within the App, which permanently removes all associated data.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to access another user's data or account.
- Reverse-engineer, decompile, or disassemble the App.
- Interfere with or disrupt the App's infrastructure.
- Use the App to transmit harmful, abusive, or objectionable content through journal entries or connection features.
- Misrepresent your identity or impersonate another person.
5. Subscriptions and Purchases
- VirWave offers both free and premium features.
- Premium features are available through in-app purchases managed by Apple (App Store) or Google (Google Play).
- Subscription terms, pricing, billing, and cancellation are governed by the respective app store's terms.
- You may restore previous purchases at any time from within the App.
- We do not process or store payment card information directly. All payment processing is handled by Apple or Google.
6. Intellectual Property
- The App, its design, code, visual assets, breathing patterns, and content are owned by VirWave OAM and are protected by applicable intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
- You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
7. User Content
- Content you create in the App (journal entries, breathing presets, profile information) remains yours.
- By using the App, you grant us a limited license to store and process your content solely to provide the Service to you.
- We do not claim ownership of your content and do not use it for any purpose other than delivering the App's features.
8. Privacy
Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.
9. Health Disclaimer
VirWave is an emotional regulation tool designed to support breathing practice and nervous system regulation. It is not a substitute for professional medical or mental health care.
- The App does not diagnose, treat, cure, or prevent any disease or condition.
- If you are experiencing a mental health crisis, please contact a qualified professional or emergency service immediately.
- In-app crisis resources are provided as informational links only and do not constitute professional advice.
- Consult your healthcare provider before beginning any new breathing or regulation practice, especially if you have a respiratory, cardiovascular, or other medical condition.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VIRWAVE OAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
12. Termination
- You may stop using the App and delete your account at any time.
- We reserve the right to suspend or terminate access to the App if you violate these Terms.
- Upon termination, your right to use the App ceases immediately.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top. Continued use of the App after changes constitutes acceptance of the updated Terms.
If we make material changes, we will make reasonable efforts to notify you through the App or by email.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VirWave OAM operates, without regard to conflict of law principles.
